Sweepstakes Official Rules 

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE AN INDIVIDUAL’S CHANCES OF WINNING. PARTICIPATION IN THE SWEEPSTAKES CONSTITUTES YOUR ACCEPTANCE OF THESE OFFICIAL RULES, WHICH INCLUDE A CLASS ACTION WAIVER (SEE SECTION 8). IF YOU DO NOT AGREE TO BE BOUND BY THESE OFFICIAL RULES, YOU MUST NOT ENTER THE SWEEPSTAKES. THIS SWEEPSTAKES IS IN NO WAY SPONSORED, ENDORSED, ADMINISTERED BY, OR ASSOCIATED WITH INSTAGRAM, META, OR TIKTOK. 

1. Eligibility: Scotts ‘Stars, Stripes, and Slip 'n Slides’ Giveaway (the “Sweepstakes”) is open to legal U.S. residents of the 50 United States and the District of Columbia, who are at least eighteen (18) years of age and the age of majority in their jurisdiction of residence, (19 in Alabama and Nebraska; 21 in Mississippi) at the time of entry. The Sweepstakes is governed by U.S. law and is subject to all applicable federal, state and local laws and regulations. Employees, officers and directors of The Scotts Company LLC (“Sponsor”) and its respective parents, affiliates, subsidiaries, advertising or promotion agencies (collectively, “Sweepstakes Entities”), and each of the foregoing’s immediate family members and/or those living in the same household are not eligible to participate or win in the Sweepstakes. Void where prohibited. Winning a prize is contingent upon fulfilling all requirements set forth herein. 

2. Timing: The Sweepstakes begins on Thursday, July 2, 2026 at 10:00 a.m. Eastern Time (“ET”) and ends on Monday, July 6, 2026 at 11:59:59 p.m. ET (the “Sweepstakes Period”). Sponsor’s computer shall be the official time keeping device for this Sweepstakes. 

3. How to Enter: Entry into the Sweepstakes requires access to the internet and an account set to public on at least one of the following platforms (each, a “Platform”): Instagram or TikTok. 

During the Sweepstakes Period, eligible individuals must complete the following steps: 

1. Follow @scottslawn on Instagram 

2. Like the giveaway post 

3. Comment on the giveaway post and tag a friend 

Upon completion of the above steps, you (“Entrant”) will automatically receive one (1) entry (“Entry”) into the Sweepstakes. LIMIT ONE (1) ENTRY PER PERSON. Entries submitted in excess of this limitation will be disqualified. 

By entering the Sweepstakes, and publishing a Post on a Platform, Entrant agrees that Sponsor may: (i) repost, share, and use the Entry without limitation on Sponsor’s social media pages or for other promotional purposes without any notice or compensation to Entrant; (ii) contact Entrant via Platform Direct Message, and/or (iii) name or tag Entrant on Sponsor’s social media pages. By entering the Sweepstakes, Entrant represents and warrants that: (i) they have the right to grant the rights granted in these Official Rules with respect to any Post; (ii) the consent of no other person, firm, corporation or other entity is required to enable Sponsor to exercise the rights granted in these Official Rules with respect to the Post; (iii) Sponsor’s use of the Post will not violate the rights of any third party; and (iv) Sponsor shall have the right to use the Post free and clear of any claims for royalties, licenses, or other compensation. 

Normal Internet access, message, data rates, and usage charges imposed by online or phone services may apply. Entries must be submitted by Entrant. Automated or bulk Entries or Entries submitted by third parties will be disqualified. All required steps must be followed for the Entry to be valid. Incomplete, illegible, corrupted, non-public, or untimely Entries are void and will be disqualified. Multiple Entrants are not permitted to share the same email address, Instagram, or TikTok account. In the event of a dispute as to the identity of an Entrant, the authorized account holder of the email address registered to the Instagram or TikTok account, as applicable, will be determinative. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder or forfeit the prize. If a dispute cannot be resolved to Sponsor’s reasonable satisfaction, the Entry will be deemed ineligible. Sponsor shall not be responsible for lost, misdirected, misplaced, stolen, tampered with, deleted, non-public, or invalid Entries or any expenses incurred in the creation and submission of any Entry. 

Entries, comments, and any content submitted or uploaded to any social media site or other public sites in connection with this Sweepstakes (collectively, “Content Submissions”) must be original to Entrant, Entrant must own all rights in/to the Content Submission, and Content Submissions may not contain, depict or show any content that: (i) contains images or products related to a competitor of Sponsor; (ii) is offensive, lewd, profane, obscene; (ii) promotes any activities that may appear unsafe or dangerous, or any political agenda or message; (iii) defames, misrepresents or contains disparaging remarks about a third party; (iv) communicates messages or images inconsistent with the positive image and good will of Sponsor’s brands; (v) includes any music or visuals not cleared for use on the Platform; and/or (vi) violates any law. Any Content Submission that contains such content will be disqualified. Sponsor reserves the right in its sole and unfettered discretion to disqualify any Content Submission that it believes to be inappropriate, that does not comply with these Official Rules, or that is not consistent with the spirit or theme of the Sweepstakes. 

4. Prizes/ Odds: There are a total of two (2) prizes (each, a “Prize”) available to be awarded during the Sweepstakes. 

● First Prize: The first selected winner (“First Prize Winner”) will receive their choice of either one (1) bounce house or one (1) slip 'n slide, plus a Scotts product package valued at approximately two hundred and fifty US dollars ($250.00). 

● Second Prize: The second selected winner (“Second Prize Winner”) will receive the alternative recreational item not selected by the First Prize Winner (either the bounce house or the slip 'n slide), plus a Scotts product package valued at approximately two hundred and fifty US dollars ($250.00). 

The Approximate Retail Value (“ARV”) of each Prize will depend on the final items selected but is estimated at four hundred and fifty US dollars ($450.00) and five hundred US dollars ($500.00) each. Total ARV for all Prizes is nine hundred and fifty US dollars ($950.00). 

Odds of winning a Prize depend on the number of eligible Entries received. Winner is responsible for any and all local, state and/or federal taxes associated with the use or acceptance of Prize as well as any other costs and expenses not specified herein. Prize is non-assignable and non-transferable and cannot be redeemed for cash; however, Sponsor reserves the right in its sole discretion to substitute a prize of comparable value if Prize is unavailable. LIMIT 1 PRIZE PER PERSON. In the event there is a discrepancy or inconsistency between statements contained in any Sweepstakes promotional materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern and control. 

5. Winner Selection/Winner Notification: On or about July 7, 2026, two (2) individuals (each, a “Potential Prize Winner”) will be chosen in one (1) random drawings to be conducted by Sponsor or Sponsor’s designee from among all eligible entries received on each Platform during the Sweepstakes Period. Potential Prize Winners will be notified via direct message on Instagram. It is a Potential Prize Winner’s responsibility to monitor his/her Platform direct messages to see if they are a Potential Prize Winner. Sponsor is not responsible for and shall not be liable for late, lost, damaged, intercepted, misdirected, or unsuccessful efforts to notify Potential Prize Winners. Potential Prize Winner must respond within five (5) days of Notification and, non response within those five (5) days will disqualify the Potential Prize Winner. Potential Prize Winner may be required to sign and return an Affidavit of Eligibility/Release of Liability, and where legally permissible a Publicity Release along with any other document Sponsor deems necessary to verify eligibility of Entrant or provide prize within the time specified in the Notification. Failure by Potential Prize Winner to return any required documentation prior to the deadline date may result in disqualification and the selection of an alternate Potential Prize Winner. If any Potential Prize Winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines a prize for any reason prior to award, and/or if a Notification is returned as undeliverable, such Potential Prize Winner will be disqualified and an alternate Potential Prize Winner may be selected in a random drawing from among the remaining eligible Entries. Only one (1) alternate drawing will be held, after which any remaining prize will remain un-awarded. 

POTENTIAL PRIZE WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE SWEEPSTAKES. AN ENTRANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL ENTRANT’S ELIGIBILITY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. Upon verification of eligibility, a Potential Prize Winner will be deemed a “Sweepstakes Winner”. 

6. Publicity Release: Except where prohibited, participation in the Sweepstakes constitutes Sweepstakes Winners’ consent to Sponsor’s use of their name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, in perpetuity, without further payment or consideration, and entrant releases the Sponsor from all claims arising out of the use of such information. NOTHING CONTAINED HEREIN SHALL BE DEEMED TO OBLIGATE SPONSOR TO MAKE USE OF ANY OF THE RIGHTS GRANTED HEREIN AND WINNERS WAIVE ANY RIGHT TO INSPECT OR APPROVE ANY SUCH USE OF ANY AND EVERY NATURE AND KIND. 

7. General Conditions; Privacy; Releases: Participation in the Sweepstakes constitutes Entrant’s full and unconditional agreement to these Official Rules and to Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. Sponsor and its agencies are not responsible for lost, late, incomplete, damaged, stolen, misdirected, or illegible entries; lost, interrupted, or unavailable network, server, or other connections, garbled transmissions or miscommunications, telephone transmission problems; computer or software malfunctions or damage to a user’s computer equipment (software or hardware); technical failures; or other errors or malfunctions of any kind whether human, mechanical, electronic, or otherwise. Proof of sending or submission of Entry will not be deemed proof of receipt of same by Sponsor. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. 

Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures, human error or any other factor impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the registration process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

BY PARTICIPATING IN THIS SWEEPSTAKES, ENTRANT AGREES THAT SPONSOR, META, FACEBOOK, TIKTOK, AND THEIR RESPECTIVE PARENT COMPANIES, AFFILIATES, SUBSIDIARIES, REPRESENTATIVES, CONSULTANTS, CONTRACTORS, LEGAL COUNSEL, ADVERTISING, PUBLIC RELATIONS, PROMOTIONAL, FULFILLMENT AND MARKETING, WEBSITE PROVIDERS, WEB MASTERS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AND AGENTS (THE “RELEASED PARTIES”) WILL HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY ENTRANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING PERSONAL INJURY OR DEATH, OR PROPERTY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, MISUSE, OR USE OF THE PRIZE, ENTRY, OR PARTICIPATION IN THIS SWEEPSTAKES OR IN ANY SWEEPSTAKES-RELATED ACTIVITY (INCLUDING ENTRY), OR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY, OR MERCHANDISE DELIVERY. THE RELEASED PARTIES ARE NOT RESPONSIBLE IF ANY PRIZE CANNOT BE AWARDED DUE TO CANCELLATIONS, DELAYS, OR INTERRUPTIONS DUE TO ACTS OF GOD, ACTS OF WAR, NATURAL DISASTERS, WEATHER, OR TERRORISM. BY PARTICIPATING IN THIS SWEEPSTAKES, ENTRANT AGREES THAT THE RELEASED PARTIES WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY INJURIES, DAMAGES, OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES TO PERSONS, INCLUDING DEATH, OR TO PROPERTY ARISING OUT OF ACCESS TO AND USE OF ANY WEBSITE ASSOCIATED WITH THIS SWEEPSTAKES OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SUCH SITE. 

BY SUBMITTING AN ENTRY, ENTRANT AGREES THAT SUCH ENTRY, COMMUNICATIONS OR CONTENT SUBMISSIONS (COLLECTIVELY, “SUBMISSIONS”) THAT ENTRANT MAY SUBMIT TO SPONSOR OR POST IN CONNECTION WITH THIS SWEEPSTAKES, INCLUDING ALL RIGHTS EMBODIED THEREIN, WITH THE EXCEPTION OF PERSONALLY IDENTIFIABLE INFORMATION AS DEFINED IN SPONSOR’S PRIVACY POLICY, SHALL BE DEEMED TO BE NON-CONFIDENTIAL, NON-PROPRIETARY, AND SPONSOR SHALL HAVE NO OBLIGATION OF ANY KIND WITH RESPECT TO SUCH SUBMISSIONS AND SHALL BE FREE TO EDIT, EXPLOIT, MODIFY, PUBLISH, REPRODUCE, USE, DISCLOSE, DISSEMINATE AND DISTRIBUTE THE SUBMISSIONS TO OTHERS WITHOUT LIMITATION IN ANY AND ALL MEDIA NOW KNOWN OR NOT CURRENTLY KNOWN, THROUGHOUT THE WORLD IN PERPETUITY FOR ANY PURPOSE WITHOUT COMPENSATION, PERMISSION, OR NOTIFICATION TO ENTRANT OR ANY THIRD PARTY. ENTRANT REPRESENTS AND WARRANTS THAT ALL SUBMISSIONS WILL BE ORIGINAL TO THEM, AND THAT NO PORTION OF THE SUBMISSION WILL INFRINGE THE RIGHTS OF ANY THIRD-PARTY. ENTRANT HEREBY GRANTS TO THE SPONSOR AND ITS LEGAL REPRESENTATIVES, SUCCESSORS AND ASSIGNS, AN IRREVOCABLE, AND WORLDWIDE LICENSE TO USE IN PERPETUITY THE SUBMISSIONS IN ANY FORM OR FORMAT AND TO MODIFY THE SAME AND ACKNOWLEDGES AND AGREES THAT IF SPONSOR DOES USE THE SUBMISSIONS ENTRANT SHALL NOT BE ENTITLED TO ANY CREDIT, CONSIDERATION, NOTICE OR PAYMENTS OF ANY KIND. ENTRANT WAIVES ANY MORAL RIGHTS HE OR SHE MAY HAVE TO THE SUBMISSIONS AND AGREES THAT IF SPONSOR ELECTS TO USE SUBMISSIONS FOR ANY PURPOSE, ALL RIGHTS UNDER COPYRIGHT OR OTHER INTELLECTUAL PROPERTY RIGHTS WHICH MAY RESULT FROM THAT RELATING TO ENTRANT’S SUBMISSIONS OR FROM USE OF THE SAME BY SPONSOR SHALL BE THE SOLE PROPERTY OF SPONSOR. ENTRANT FURTHER AGREES THAT IF SPONSOR ELECTS TO USE ENTRANT’S SUBMISSIONS, ENTRANT WILL EXECUTE ANY DOCUMENTS REQUESTED BY SPONSOR REGARDING THIS ASSIGNMENT. IF ANY USE BY SPONSOR OF THE SUBMISSIONS CAUSES IT TO BE LIABLE TO ANY THIRD-PARTY, ENTRANT AGREES TO INDEMNIFY SPONSOR AND ITS AGENTS, EMPLOYEES, AFFILIATES, SUBSIDIARIES, REPRESENTATIVE AND ALL RELATED PARTIES FROM AND AGAINST ANY AND ALL DAMAGES, COSTS, JUDGMENTS AND EXPENSES (INCLUDING REASONABLE ATTORNEY FEES) WHICH IT INCURS AS A RESULT OF ITS USE OF THE SUBMISSIONS. SUBMISSIONS WILL NOT BE RETURNED TO ENTRANTS. 

WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS SWEEPSTAKES, INCLUDING ANY WEBSITE ALL PRIZES, ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSIONS OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY. CHECK LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS. 

8. Disputes. Except where prohibited, Entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the state and federal courts located in Ohio; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes shall be governed by, and construed in accordance with, the laws of the State of Ohio, without giving effect to any choice of law or conflict of law rules (whether of State of Ohio or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Ohio. 

9. Winners List: To obtain the name of the Sweepstakes Winners, send a self-addressed stamped envelope to: Scotts Lawns Sweepstakes, 14111 Co Hwy 105, Marysville, OH 43040. All such requests must be received by January 31, 2027.
